These Terms & Conditions (“Terms”) govern your use of the Rocky’s Junk Removal website and the services provided by Rocky’s Junk Removal (“Rocky’s,” “we,” “us,” or “our”).
By using our website, requesting an estimate, scheduling a service, or hiring Rocky’s, you agree to these Terms.
1. Our Services
Rocky’s provides junk removal, property cleanouts, demolition, hauling, and related services.
The specific services provided will depend on the scope of work agreed upon between Rocky’s and the customer.
Services may include, but are not limited to:
- Residential junk removal
- Commercial junk removal
- Property cleanouts
- Estate cleanouts
- Moving and eviction cleanouts
- Demolition and removal
- Furniture removal
- Appliance removal
- Construction debris removal
- Property cleanup and related hauling services
Not all materials or services are accepted or available in every circumstance.
2. Estimates and Pricing
Estimates provided by Rocky’s are based on the information available to us at the time of the estimate.
Final pricing may change if:
- The actual quantity or volume of material differs from what was represented
- Additional items are added
- The condition or accessibility of the property differs from what was represented
- Additional labor is required
- Hazardous, prohibited, or otherwise undisclosed materials are discovered
- The customer requests additional services
- Conditions at the property materially differ from the original scope of work
Unless otherwise stated in writing, an estimate is not a guaranteed final price until the scope and pricing have been confirmed by Rocky’s.
3. Customer Responsibilities
The customer is responsible for:
- Providing accurate information about the job
- Identifying items that should and should not be removed
- Providing reasonable access to the property and items being removed
- Obtaining any required permission to authorize work at the property
- Informing Rocky’s of known hazards, restricted areas, or special property conditions
- Removing or securing valuables, important documents, cash, jewelry, medications, and other personal items before our arrival
Rocky’s is not responsible for items that the customer fails to identify as excluded from removal.
4. Property Access
By scheduling services, the customer represents that they have the legal authority or permission necessary to allow Rocky’s to enter the property and perform the requested work.
If the customer is not the property owner, the customer is responsible for obtaining any required authorization from the owner, landlord, property manager, or other applicable party.
Rocky’s may refuse or postpone service if we reasonably believe that we do not have proper authorization to access the property or remove the requested materials.
5. Items We Cannot Remove
Rocky’s reserves the right to refuse removal of items that are hazardous, illegal, unsafe, contaminated, or otherwise unsuitable for our equipment, employees, disposal facilities, or transportation.
Examples may include certain:
- Hazardous chemicals
- Explosives
- Ammunition or firearms
- Biohazardous materials
- Certain medical waste
- Highly contaminated materials
- Unidentified substances
- Materials prohibited by disposal facilities or applicable law
If you are unsure whether we can remove something, please contact us before scheduling service.
6. Hidden Conditions
Rocky’s is not responsible for conditions that could not reasonably be identified before work begins.
Examples may include concealed damage, unsafe structures, hidden materials, inaccessible areas, infestation, excessive weight, or other conditions that materially change the difficulty or safety of the job.
If these conditions are discovered, Rocky’s may adjust the price, modify the scope of work, or decline the affected portion of the work.
7. Damage and Existing Conditions
Rocky’s will use reasonable care while performing services.
However, the customer understands that moving heavy, oversized, awkward, damaged, or tightly positioned items can involve a risk of damage to floors, walls, ceilings, doors, stairs, landscaping, driveways, furniture, or other property.
Existing damage, weakened structures, deteriorated flooring, narrow access points, concealed conditions, and similar circumstances may increase the risk of damage.
Rocky’s is not responsible for damage caused by pre-existing conditions, concealed defects, structural deficiencies, or circumstances outside our reasonable control.
Any property damage caused directly by Rocky’s will be addressed in accordance with applicable law and the circumstances of the incident.
8. Valuables and Personal Property
Customers are responsible for removing valuables and personal belongings they wish to keep before Rocky’s begins work.
Rocky’s may rely on the customer's instructions regarding what is intended for removal.
Rocky’s is not responsible for personal property accidentally included with items designated for removal when the customer or an authorized representative has identified those items for disposal.
9. Cancellations and Scheduling
Customers should provide as much notice as reasonably possible if they need to cancel or reschedule an appointment.
Depending on the circumstances, Rocky’s may charge a cancellation or scheduling fee if a customer cancels with insufficient notice or prevents our team from completing a scheduled job.
Any applicable cancellation terms communicated to the customer at the time of booking will also apply.
10. Payment
Payment is due according to the terms provided in the customer's estimate, invoice, or service agreement.
Rocky’s may require payment at the completion of service unless different payment terms have been agreed to in writing.
We reserve the right to pause or refuse additional services for accounts with unpaid balances.
11. Nonpayment
If an amount owed to Rocky’s remains unpaid, we may take reasonable steps to collect the outstanding balance, including contacting the customer, sending payment demands, using third-party collection services, or pursuing available legal remedies.
The customer may be responsible for reasonable collection costs, attorney fees, court costs, or other costs to the extent permitted by applicable law.
12. Disposal and Recycling
Rocky’s may transport collected materials to landfills, transfer stations, recycling facilities, donation centers, or other appropriate disposal locations.
We determine the appropriate disposal method based on the type and condition of the material, applicable laws, facility requirements, and operational considerations.
We do not guarantee that a particular item will be recycled, donated, reused, or otherwise diverted from disposal.
13. Photos and Documentation
Rocky’s may photograph or document work performed for estimating, scheduling, quality control, customer service, insurance, or business-record purposes.
Customers may provide photographs or videos of their property to assist with estimates.
If Rocky’s wishes to use identifiable photographs of completed work for advertising or promotional purposes, we will do so in accordance with our Privacy Policy and any applicable permissions.
14. Website Use
You may use our website for lawful purposes only.
You agree not to:
- Interfere with the operation or security of the website
- Attempt to gain unauthorized access to systems or information
- Submit false or misleading information
- Use the website for fraudulent or unlawful purposes
- Copy or reproduce website content without permission
We may modify, suspend, or discontinue any portion of the website at any time.
15. Third-Party Services
Rocky’s may use third-party companies and platforms for payment processing, scheduling, communications, advertising, analytics, disposal, recycling, and other business functions.
We are not responsible for the independent actions, policies, or services of third parties.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Rocky’s will not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our website or services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Rocky’s Junk Removal and its owners, employees, contractors, and representatives from claims, damages, losses, liabilities, and expenses arising from:
- Your violation of these Terms
- Your lack of authorization to request services
- Misrepresentation of the property or materials
- Failure to disclose known hazards or relevant conditions
- Your unlawful use of our services or website
18. Force Majeure
Rocky’s will not be responsible for delays or inability to perform services caused by circumstances beyond our reasonable control, including severe weather, accidents, road closures, equipment failure, labor disruptions, government actions, disposal facility closures, or other unforeseen circumstances.
19. Changes to These Terms
Rocky’s may update these Terms from time to time.
Updated Terms will be posted on this page with a revised Effective Date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms to the extent permitted by law.
20. Governing Law
These Terms will be governed by the laws applicable to the services and transaction, without regard to conflict-of-law principles, except where applicable law requires otherwise.
21. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
22. Entire Agreement
These Terms, together with any written estimate, proposal, invoice, service agreement, or other written agreement provided by Rocky’s, constitute the agreement governing the applicable services.
If there is a conflict between these Terms and a specific written service agreement, the specific written agreement will control to the extent of the conflict.
